Terms of Service
Plain-English summary (the full terms below control): the free builder is provided as is, for you to use at your own risk. The paid embed is a month-to-month or yearly licence we can end at any time, and so can you. You are responsible for checking every file before you print it and for having the rights to the artwork you use. Our liability to you is capped at what you paid us in the last three months, and we are never liable for lost profits, wasted film, misprints or other indirect losses.

1. Acceptance
These Terms of Service (the "Terms") are a binding agreement between you and Marcotte LLC. By using freegangsheetmaker.com, the gang sheet builder, the embeddable builder, the licensee dashboard, or any related software, page or service (together, the "Services"), you accept these Terms. If you use the Services on behalf of a business, you represent that you have authority to bind that business, and "you" means that business. If you do not agree, do not use the Services.
2. The services
The free builder at freegangsheetmaker.com arranges transparent PNG files into a print-ready layout in your web browser. The embed ("Gang Sheet Builder Embed") is a paid licence that lets you place the builder on your own website with your settings. The dashboard is where licensees manage settings, domains and billing. We may add, change or remove features at any time.
3. Eligibility and accounts
You must be at least 18 years old and able to form a binding contract. Paid licences are for business use. You are responsible for the email address on your account, for everything done through your account or licence keys, and for keeping your keys confidential. Sign-in links are sent to the account email; anyone with access to that inbox can access the account. Tell us promptly at support@marcotte.ink if you believe your account has been compromised.
4. Embed licence
Subject to these Terms and payment of the applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable licence to embed the builder on the number of websites allowed by your plan, on domains you register in the dashboard, for the purpose of letting your own customers build gang sheets. You may not:
- resell, sublicense, rent or lease the builder or your licence keys, or offer the builder as a service to third parties other than visitors to your own sites;
- copy, modify, reverse engineer, decompile or create derivative works of the Services, except where the law expressly allows it;
- remove or alter any notice, badge or attribution your plan requires;
- circumvent domain locking, plan limits, usage limits or any other technical control;
- use the Services to build a competing product.
All rights not expressly granted are reserved. The licence ends automatically when your subscription ends or these Terms are terminated.
5. Fees, trials and billing
- Subscriptions. Paid plans are billed in advance, monthly or yearly, through Stripe, and renew automatically until cancelled. Prices are shown at checkout and may be changed with at least 30 days' notice by email or on the website; changes apply from your next renewal.
- Trials. A free trial requires a valid payment method and converts to a paid subscription at the end of the trial unless you cancel first. One trial per business.
- Cancellation. You can cancel at any time from the dashboard's Billing page. Cancellation takes effect at the end of the current billing period; the embed keeps working until then.
- No refunds. Fees are non-refundable, including for partial periods, unused time, downgrades or features you did not use, except where the law requires otherwise or we decide, at our sole discretion, to make an exception.
- Taxes. Fees exclude taxes. You are responsible for any sales, VAT or similar taxes that apply to your purchase.
- Failed payments. If a payment fails, we may suspend the licence until it is paid.
6. Termination and suspension
By us. We may suspend or terminate your access to any part of the Services, any licence, or these Terms, at any time, for any reason or for no reason, with or without notice, including if we believe you have breached these Terms, if your use creates risk or legal exposure for us, if a payment fails, or if we discontinue the Services. Where termination is not for breach, we will refund any prepaid fees for the unused portion of your then-current term; that refund is your sole remedy for such a termination.
By you. You may stop using the free builder at any time and may cancel a paid licence as described in section 5.
Effect. On termination, your licence ends, embeds stop receiving settings, and we may delete your account data after a reasonable period. Sections 7 and 10 through 18 survive termination.
7. Your artwork and content
You keep all rights to the artwork, images and settings you use with the Services ("Your Content"). You represent and warrant that you own or have the rights needed to use and print Your Content, and that it does not infringe anyone's intellectual property, publicity, privacy or other rights, or any law.
By default, artwork is processed in the browser and is not uploaded to us. Where you or your customers choose a feature that sends files to a server (for example a webhook or hosted transfer), you grant us a limited licence to store and transmit those files solely to provide that feature. We may delete transferred files after the retention period shown in the dashboard.
You are responsible for your print output. The Services produce layout files based on the settings and artwork supplied. You must verify every file (size, resolution, placement, colour, margins and content) before printing or sending it to a customer. We are not responsible for misprints, wasted material, wrong sizes, colour differences, resolution problems, missed deadlines or any other print result.
8. Acceptable use
You may not use the Services to do anything unlawful, to infringe anyone's rights, to transmit malware, to overload or interfere with the Services, to probe or breach their security, to scrape them, to send unsolicited messages, or to misrepresent your relationship with us. We may investigate and act on suspected violations, including by suspending access and involving law enforcement.
9. Availability and changes
We aim to keep the Services available but do not promise any uptime, and we may change, suspend or discontinue any part of the Services at any time. Features marked beta, preview or coming soon are provided for evaluation and may change or be withdrawn without notice. We may impose limits on usage, storage or transfers.
10. No warranty
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS, IMPLIED OR STATUTORY, INCLUDING ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, OR THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE OR FREE OF HARMFUL COMPONENTS. WE DO NOT WARRANT ANY RESULT OR OUTPUT, INCLUDING THAT ANY FILE IS SUITABLE FOR PRINTING. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
11. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, MARCOTTE LLC AND ITS OWNERS, EMPLOYEES, CONTRACTORS AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, BUSINESS, GOODWILL, DATA, OR FOR WASTED MATERIALS, MISPRINTS, REPRINTS, SHIPPING, OR THE COST OF SUBSTITUTE SERVICES, ARISING OUT OF OR RELATED TO THE SERVICES OR THESE TERMS, HOWEVER CAUSED AND UNDER ANY THEORY OF LIABILITY, EVEN IF WE WERE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE FEES YOU PAID US IN THE THREE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM AND (B) FIFTY US DOLLARS (US$50). FOR THE FREE BUILDER, OUR TOTAL LIABILITY IS LIMITED TO US$50. THESE LIMITS APPLY EVEN IF A REMEDY FAILS OF ITS ESSENTIAL PURPOSE.
12. Indemnification
You will defend, indemnify and hold harmless Marcotte LLC and its owners, employees, contractors and suppliers from and against all claims, damages, losses, liabilities, costs and expenses (including reasonable attorneys' fees) arising out of or related to: Your Content; your use of the Services or any output; your websites, products, customers or print jobs; your breach of these Terms; or your violation of any law or third-party right. We may take over the defence of any matter subject to indemnification, in which case you will cooperate with us.
13. Third-party services
The Services rely on third parties, including Stripe (payments), Cloudflare (hosting and storage) and email providers. Their terms govern their services, and we are not responsible for them. Your use of Stripe's checkout and billing pages is subject to Stripe's terms and privacy policy. Websites and platforms on which you embed the builder (for example Shopify, WordPress, Wix or Squarespace) are your responsibility.
14. Privacy
The free builder processes artwork in your browser and does not upload it. We collect the information needed to run the Services: account email, licence settings, allowed domains, billing status from Stripe (we never see full card numbers), anonymous usage counts (such as the number of sheets built), and standard web analytics. We use this information to provide, secure, bill for and improve the Services and to contact you about your account. We do not sell personal information. You can request deletion of your account data by emailing support@marcotte.ink; we may retain records needed for billing, legal or security purposes. If you embed the builder, you are responsible for your own privacy notices to your customers.
15. Intellectual property
The Services, including all software, design, text, graphics, layout engines and trademarks (including "Free Gang Sheet Maker"), are owned by Marcotte LLC or its licensors and are protected by intellectual property laws. Except for the limited licence in section 4, nothing in these Terms gives you any right in the Services. If you send us feedback or suggestions, we may use them without obligation to you.
16. Changes to these terms
We may update these Terms from time to time. The effective date at the top shows the current version. For material changes to paid licences we will give notice by email or in the dashboard at least 14 days before they take effect. Continued use of the Services after a change means you accept the updated Terms. If you do not agree, stop using the Services and cancel any subscription before the change takes effect.
17. Governing law and disputes
These Terms are governed by the laws of the State of Illinois, USA, without regard to its conflict-of-laws rules. Any dispute arising out of or related to the Services or these Terms will be brought exclusively in the state or federal courts located in DuPage County, Illinois, and you consent to their personal jurisdiction. To the extent permitted by law, you and we each waive any right to a jury trial and agree that disputes will be resolved individually, not as a plaintiff or class member in any class, consolidated or representative action. Any claim must be filed within one year after it arises or it is permanently barred. Nothing in this section prevents either party from seeking injunctive relief to protect intellectual property.
18. General
- Entire agreement. These Terms, together with your checkout and the plan details shown at purchase, are the entire agreement between you and us about the Services and replace any prior agreements.
- Severability. If any part of these Terms is held unenforceable, the rest remains in effect and the unenforceable part is modified to the minimum extent needed.
- No waiver. Our failure to enforce any part of these Terms is not a waiver of our right to do so later.
- Assignment. You may not assign or transfer these Terms or your licence without our written consent. We may assign them freely, including to a successor.
- Force majeure. We are not liable for any failure or delay caused by events beyond our reasonable control.
- Independent parties. No partnership, joint venture, employment or agency relationship is created by these Terms.
- Notices. We may notify you by email to your account address or by posting in the dashboard or on the website. Notices to us go to support@marcotte.ink.
- Export and sanctions. You may not use the Services in violation of US export or sanctions laws.
